General terms and conditions

These terms apply to all contracts concluded via our website or by email. For purchases via our eBay shop, the rules there apply in addition.

This English translation is for your information only. The German version is the legally binding one.

§ 1 Provider and scope

The provider is YKsystems, owner Yakaria Michael Yoboua, Behlstr. 4, 65366 Geisenheim, Germany, email: kontakt@yk-systems.de, VAT ID: DE458719505.

These general terms and conditions apply to all contracts for the supply of computer systems, hardware and related services concluded between us and you. Deviating terms of the customer do not become part of the contract unless we expressly agree to them in writing.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession. A business is anyone acting in the exercise of their trade, business or self-employed profession.

§ 2 Conclusion of the contract

The presentation of our systems on this website is not a legally binding offer, but a non-binding invitation to send us a request.

If you send us a request via the request form or by email, we will then prepare an individual, non-binding quote for you in text form. A contract is only concluded when you expressly accept this quote, for example by confirming by email, and we confirm the order.

We store the contract text. You receive all contract details and these terms in text form with our order confirmation.

§ 3 Prices

All prices are final prices in euros and include the statutory VAT of currently 19 %. Shipping within Germany is included in the price; for deliveries abroad we make a separate agreement.

The price stated in the individual quote is always decisive. Prices on the website are starting prices for the basic configuration described there.

The prices in our quote are valid for seven calendar days from the date of the quote. If you accept the quote later, we recalculate it with the then current component prices and send you a new quote. The reason: RAM, storage and graphics cards currently often change their prices within a few days.

§ 3a Voucher for newsletter subscribers

Anyone who subscribes to our newsletter and confirms the subscription receives a voucher worth €25. The following applies:

  • The voucher can be used once for buying your first YKON system or custom PC from YKsystems.
  • It cannot be combined with other discounts or vouchers, except the refer-a-friend discount, and is not paid out in cash.
  • It is valid for 12 months from confirming your newsletter subscription and stays valid if you unsubscribe later.
  • There is one voucher per person and email address.

The voucher is deducted from the final price in the quote. Mention the code in your request or in your reply to the quote. If a purchase is cancelled, the voucher is reinstated, provided it is still valid.

§ 3b Gift vouchers

On our website you can buy vouchers: gift cards worth €50, €100 or €250, and vouchers for a parts list (€49) or an assembly (€99). Payment is made in advance. We send the voucher with its code by email once payment has been received. The following applies:

  • The voucher is valid until 31 December of the third year after purchase.
  • It is not paid out in cash. A gift card can be spread over several purchases, any remaining balance stays valid until it expires.
  • The assembly voucher applies to a PC whose parts we order. We do not fit parts you bring along.
  • Whoever has the code can redeem it. Please keep it as safe as cash. If it is lost, we replace it on proof of purchase, as long as it has not been redeemed.

When buying a voucher you have a right of withdrawal of 14 days, see the cancellation policy. After a withdrawal we refund the amount and the voucher becomes invalid.

§ 4 Payment

We offer the following payment methods:

  • Payment in advance by bank transfer: you will find the bank details on the invoice or in our order confirmation.
  • PayPal, by arrangement in the quote.
  • Cash on collection: against a receipt on handover.
  • Payment in instalments, only by individual written agreement, see § 5.

With payment in advance, the invoice amount is payable within seven days of the order confirmation. We start building your system once payment has been received or, if payment in instalments has been agreed, once the first instalment has been received.

§ 5 Payment in instalments

Payment in instalments is possible if we expressly agree to it in the individual case. The instalment plan with the amount, number and due dates of the instalments is recorded in writing or in text form. This does not cause you any additional costs or interest.

If you are in default with at least two consecutive instalments, we are entitled to demand the entire remaining amount after unsuccessfully sending you a reminder with a reasonable deadline.

§ 6 Delivery and collection

We do not keep components in stock. Every system is purchased to your order, built by hand and tested in a 24-hour stress test before shipping. The expected delivery time is therefore usually 7 to 10 working days from receipt of payment; the binding time for your order is stated in the respective quote. Should delivery be significantly delayed, we will inform you without delay.

On request you can collect your system from us in 65366 Geisenheim by appointment. We ship insured and in suitable packaging; please report externally visible transport damage promptly so that we can claim it from the shipping company. Your statutory rights remain unaffected.

In the Rheingau we deliver in person instead of shipping on request: free of charge to Geisenheim, Rüdesheim am Rhein, Oestrich-Winkel, Kiedrich, Eltville am Rhein, Lorch, Assmannshausen, for €19 to Walluf, Niederwalluf, Wiesbaden, Mainz, Taunusstein. Handover takes place at the front door at the agreed time; setup and work inside your home are not included. The delivery price is stated in the quote.

§ 7 Retention of title

The goods delivered remain our property until paid in full. This applies in particular, where payment in instalments has been agreed, until the last instalment has been paid.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. We grant it for all systems, expressly including individually configured PCs. Details and the model withdrawal form can be found in our cancellation policy.

§ 9 Liability for defects

Statutory liability for defects applies. For consumers, the limitation period for claims for defects in new goods is two years from delivery. For businesses it is one year.

If a defect in goods you bought as a consumer is remedied for the first time by repair, the limitation period is extended once by twelve months (section 475e (5) BGB). As a consumer you choose whether you want a repair or a replacement (section 439 (1) BGB).

We only fit brand-new components. Manufacturer warranties existing in addition apply independently of your statutory rights towards us and do not restrict them.

Wear and tear from normal use, damage from improper handling, power surges or modifications to the hardware are not defects. If a defect is demonstrably due to a modification you made, for example operation outside the manufacturer's specification, there are no claims to that extent. Upgrading or opening the case as such does not affect your rights.

§ 10 Software and data

If an operating system or other software is supplied, the licence terms of the respective manufacturer also apply. After handover you are responsible for complying with these terms yourself.

Before service, repair or upgrade work you are obliged to back up your data yourself. We are only liable for data loss in accordance with § 11 and only to the extent that would have arisen with proper data backup.

§ 11 Liability

We are liable without limitation for damage resulting from injury to life, body or health, for damage based on intent or gross negligence, and under the German Product Liability Act.

In the event of a slightly negligent breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, our liability is limited to the foreseeable damage typical for the contract at the time of its conclusion. Otherwise liability is excluded.

§ 12 Dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

§ 13 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in the EU, mandatory consumer protection provisions of your country of residence remain unaffected.

If the customer is a merchant, a legal entity under public law or a special fund under public law, our place of business is the place of jurisdiction for all disputes arising from this contractual relationship.

Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
